1. Who we are
bytxt.co (“bytxt”, “we”, “us”, “our”) is a website building, editing and hosting service operated by AZUA Pty Ltd (ACN 699 084 323), Australia. “You” means the business or person using bytxt. By using bytxt you agree to these terms.
2. Plain words we use
- Service — building, hosting and editing your website.
- Site — the website we build and host for you.
- Workspace — your private area (e.g. yourname.bytxt.co) where your site lives before it goes to your own domain.
- Edit request — a change you ask for by text message or email.
- Publish — when you reply PUBLISH, a previewed change goes onto your live site.
- Your content — the text, images, logos and other materials you provide or ask us to use.
3. The service
We build a website for your business, host it, and let you request changes by text message or email. We aim to apply changes promptly but we don’t guarantee a specific turnaround. Every change is shown to you as a preview first and only goes live when you publish it. We may decline a request that is unlawful, abusive, misleading, infringing, or outside the scope of the service.
4. The demo
We may build you a demo site in your workspace before you subscribe. The demo is free, provided “as is”, and we may change or remove it at any time. A demo doesn’t become permanent until you start a paid subscription.
5. Pricing & billing
bytxt is a monthly subscription. The price, billing cycle and what’s included are shown to you before you subscribe. Payments are processed by our payment provider (Stripe); by subscribing you authorise recurring charges. Subscriptions renew automatically each cycle until cancelled. Fees are in Australian dollars unless stated otherwise. We may change pricing on reasonable notice, which won’t affect the cycle you’ve already paid for.
6. Cancellation & what happens to your site
You can cancel at any time — reply STOP, use any cancel option we provide, or email us. Cancellation stops future billing; see our Refund & Cancellation Policy for refunds. When a subscription ends we stop hosting the site and it will go offline. You keep your own content and your own domain — contact us about retrieving your content, and re-point your domain wherever you like.
7. Your content
You keep ownership of your content. You confirm you have the right to use it and that it doesn’t break the law or infringe anyone’s rights. You grant us the permission needed to host, display, adapt and back up your content as part of running the service. You’re responsible for what you ask us to publish.
8. The site we build
We licence the site we build to you for use as your business website while you’re subscribed. The underlying systems, templates, code and tooling that power bytxt remain ours. The bytxt name, brand and marks are ours; your business name, brand and marks remain yours.
9. Domains & DNS
You own and are responsible for your domain name, including registering and renewing it. To serve your site on your domain you (or we, with your permission) add DNS records pointing it to us. We aren’t responsible for outages caused by domain expiry, registrar issues, or DNS changes outside our control.
10. Acceptable use
You agree not to use bytxt for content or activity that is unlawful, misleading, deceptive, defamatory, infringing, adult, hateful, or harmful, and not to misuse the service (e.g. attempting to break, overload or gain unauthorised access to it). We may suspend or remove a site that breaches this clause.
11. Third-party services
bytxt relies on third parties (for example payment processing, messaging, and hosting infrastructure). Your use may be subject to their terms, and we’re not responsible for their acts, outages or failures beyond our reasonable control.
12. Availability
We work to keep your site online and use reasonable care, but we don’t guarantee uninterrupted or error-free service. There may be downtime for maintenance, updates, or reasons outside our control.
13. Suspension & termination by us
We may suspend or end the service if you breach these terms, don’t pay, or use bytxt in a way that creates legal or security risk. Where reasonable, we’ll give you notice and a chance to fix the issue first.
14. Liability
The service is provided “as is”. To the extent permitted by law, we exclude implied warranties and we are not liable for indirect or consequential loss (including lost profits or data). Where we are liable, our total liability is limited to the fees you paid us in the month before the claim. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
15. Indemnity
You agree to cover us for claims, losses and costs arising from your content or your breach of these terms — for example a claim that something you asked us to publish infringes someone’s rights.
16. Privacy
We handle personal information in line with our Privacy Policy.
17. Changes to these terms
We may update these terms from time to time. Material changes will be posted on this page with a new “last updated” date. Continuing to use bytxt after a change means you accept the updated terms.
18. Governing law
These terms are governed by the laws of Queensland, Australia, and you and we submit to the courts of that jurisdiction. If any part of these terms is found unenforceable, the rest still applies.
